These terms and conditions constitute the entire agreement between you and Jetaxi regarding your use of our website and services, superseding any prior agreements or understandings, whether oral or written.

14. Reservation of Rights:

Jetaxi reserves all rights not expressly granted in these terms and conditions. No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision.

15. Force Majeure:

Jetaxi shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, strikes, natural disasters, or governmental actions.

16. Insurance Coverage:

While Jetaxi takes all necessary precautions to ensure your safety during travel, we recommend that you obtain adequate travel insurance coverage for unforeseen events or emergencies.

17. Third-Party Services:

Jetaxi may partner with third-party service providers to offer additional services or features. Your use of such third-party services is subject to their terms and conditions, and Jetaxi disclaims any liability arising from your interactions with third-party providers.

23. Termination of Services:

We reserve the right to terminate or suspend your access to our website and services without prior notice for any reason, including violation of these terms and conditions or illegal or fraudulent activities.

24. Booking Process and Confirmation:

Customers will receive a unique booking ID via email or SMS upon completing an online booking with Jetaxi. This booking ID is required to access Jetaxi's car rental services. Failure to provide the booking ID may result in the driver refusing service.

25. Payment Options:

Customers have the flexibility to make payments via e-payment for any advance payment required or at the end of travel. Alternatively, payments can also be made in cash or via e-payment directly to the driver after the completion of the journey. Please note that advance payments may be required for certain bookings, and payment methods may vary depending on the specific terms of the reservation.

26. Customer Responsibilities:

As a customer, you are responsible for providing accurate and complete information when using our services. You agree to cooperate with our drivers and adhere to all safety instructions and local laws during your journey.

27. Independent Contractors:

Drivers using the Jetaxi platform operate as independent contractors and are solely responsible for their actions, conduct, and adherence to local laws, regulations, and safety standards.

28. Independent Service Providers:

Jetaxi operates solely as a connecting platform, facilitating communication and transactions between customers and drivers who are not contracted with Jetaxi. Customers and drivers acknowledge that Jetaxi conducts a due diligence process to a certain extent in appointing drivers. However, due to the independent nature of drivers, Jetaxi cannot control or guarantee the behavior, actions, or quality of service provided by drivers.

29. Risk Acknowledgment:

Customers and drivers acknowledge that engaging in transportation services through Jetaxi involves inherent risks, including but not limited to traffic accidents, traffic delays, personal injury, property damage, theft, or other unforeseen circumstances. While Jetaxi conducts a due diligence process to a certain extent in appointing drivers, it shall not be held liable for any such risks arising from the provision of transportation services by independent drivers.

30. Customer Conduct:

Customers agree to conduct themselves in a respectful and lawful manner when using Jetaxi's services. Any misconduct, harassment, or illegal activity by customers towards drivers will not be tolerated and may result in suspension or termination of services and/or access to Jetaxi's platform.

31. Driver Conduct:

Drivers agree to provide transportation services in a professional, safe, and courteous manner. Any misconduct, negligence, or violation of laws or regulations by drivers will not be tolerated and may result in suspension or termination of services and/or access to Jetaxi's platform.

32. Safety Measures:

Jetaxi encourages both customers and drivers to prioritize safety at all times. Customers are advised to verify the identity of the driver and the vehicle before boarding. Drivers are encouraged to comply with all safety regulations, including but not limited to maintaining the vehicle in good condition, obeying traffic laws, and providing necessary safety equipment.

33. Procedures for No-Show:

33.1 - In the event of a cab no-show, when the customer has a confirmed booking for their travel date, it will be deemed as a failure on the part of the independent drivers associated with Jetaxi. Jetaxi, as a connecting platform, is committed to taking all necessary measures to promptly provide the customer with an alternative mode of transportation. However, Jetaxi shall not be held liable to reimburse the customer for any incurred expenses such as charges for accommodation, transportation tickets (such as flight, train, or bus), or any other monetary expenses resulting from the non-appearance of the cab on the scheduled day of travel.

33.2 - In case of a customer no-show after the driver has arrived at the designated location as per the booking, it will be considered the customer's responsibility. While Jetaxi strives for prompt service, it shall not be liable for any inconvenience caused. Booking fees, if any, may be forfeited in such instances.

34. Fuel Policy:

At the onset of the journey, the driver may ask the customer to make an initial fuel payment, which is obligatory upon request. Upon arrival at the destination, the final fare, accounting for the actual distance traveled and any additional charges will be calculated. Any initial fuel payment made by the customer will be subtracted from the final fare.

35. Additional Charges and Fees:

35.1 - In addition to the specified tariffs for our services, please be aware that certain extra charges and fees may apply, such as airport charges, parking fees, permit charges for out-of-state travel, surcharges, tolls, waiting time, or any other applicable fees incurred during the provision of our services. These charges are to be paid by the customers as actuals.

35.2 - Customers are liable for waiting charges if they delay the driver by more than 15 minutes from the scheduled pickup time. During travel, customers are permitted to make stops for essential needs, including food and restroom breaks. However, customers are reminded to ensure that the duration of such stops does not exceed 30 minutes. Extended waiting times may result in additional charges of Rs 150 for every exceeded hour.

35.3 - Customers are reminded that bringing pets, traveling on routes involving hills, or carrying additional luggage beyond the limits specified in the luggage policy may incur additional charges. For sedan car hires, an additional charge of Rs 300 will apply, and for SUV car hires, an additional charge of Rs 500 will apply, whichever is applicable.

35.4 - A driver bata (allowance) will be applicable for all trips. For regular trips, the driver bata is Rs 300. For trips exceeding 400 km, the driver bata is Rs 600.

36. Cancellation Policy:

Customers are entitled to cancel taxi bookings free of charge if the cancellation is made at least 4 hours prior to the scheduled departure. However, a nominal fee of Rs. 300 will be applicable if the booking is cancelled within 4 hours of the scheduled departure time. For any inquiries or assistance regarding cancellations, please contact our customer support team.

37. Trip Distance Coverage, Calculation, and Speed Regulations:

One way trips must cover a minimum distance of 130 kilometers, while round trips must cover a minimum distance of 250 kilometers. These minimum distances ensure comprehensive coverage for your travel needs. Distances for each trip are calculated from the pickup location to the destination location. Customers are required to note down the starting and ending kilometers of the trip. Drivers are required to adhere to local speed regulations enforced by transport authorities. Any request to exceed these limits places sole responsibility on the customer for any resulting consequences.

38. Accuracy of Distance Estimates:

Estimated distances between locations provided on the website are approximate. Actual distances may vary depending on specific geographical factors.

39. Car Facilities and Air-Conditioning Policies:

Amenities available in each car are based on the customer's booking preferences. Air-conditioning may not function on hilly routes or when the vehicle is stationary, and customers are advised not to request activation under these conditions.

40. Vehicle Availability and Alternatives:

Vehicle availability is subject to demand. In the event of unavailability, Jetaxi will endeavor to provide a suitable alternative in a similar vehicle segment.

41. Amendment Procedures and Time Limits:

Customers may request amendments to their bookings up to 8 hours before the scheduled pickup time. Amendments are subject to availability and must be made through Jetaxi's support team, referencing the booking ID. Customers may also request amendments to their bookings while in progress by contacting Jetaxi's support team, provided they provide the booking ID and a valid reason for the amendment.

42. Booking Validity and Usage Restrictions:

42.1 - All bookings made through our website are valid from midnight to midnight on the specified date, with one day defined as one calendar day (midnight to midnight).

42.2 - Customers are reminded that cabs booked for outstation travel are intended solely for use outside the city and cannot be utilized for city travel. Adhering to these usage restrictions is imperative to ensure optimal service delivery.

43. Passenger Limits and Service Refusal:

43.1 - Each vehicle booked through Jetaxi has a designated passenger limit to ensure safety and compliance. For sedan vehicles, the allowed capacity is up to 4 passengers, while for SUV vehicles, the allowed capacity is up to 7 passengers.

43.2 - Jetaxi reserves the right to refuse service if the number of passengers exceeds this limit. Customers are kindly reminded to adhere to these passenger limits when booking our services. Failure to comply may result in service refusal.

44. Luggage Policy:

Customers are permitted to carry a specified limit of luggage in accordance with the vehicle type booked: 3 suitcases/bags for sedan cars and 5 for SUV cars. Excess luggage may incur additional charges at the discretion of the driver.

45. Dispute Resolution:

Jetaxi is committed to resolving disputes between customers and drivers in a fair and timely manner. While we strive to facilitate effective communication and seek amicable solutions, it's important to acknowledge that Jetaxi cannot guarantee a definitive resolution in all cases. We will make every effort to address concerns and reach a satisfactory outcome for all parties involved. In the event of any dispute, both customers and drivers are asked to contact the Jetaxi support team immediately for guidance. However, customers and drivers agree that Jetaxi shall not be held liable or become directly or indirectly entangled in any legal proceedings or compelled to participate in any disputes arising from the provision of transportation services.

46. Limitation of Liability:

Jetaxi shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of its platform or the provision of transportation services by independent drivers. This includes, but is not limited to, fines, penalties, fees, or any form of compensation or monetary settlements incurred by customers or drivers during the course of their interaction or use of the Jetaxi platform.

47. Promotional Activities and Offers:

By using our services, you consent to receive promotional activities, offers, newsletters, updates, and other marketing communications from Jetaxi. These communications may be sent via email, SMS, phone calls, or other communication channels.

47.1 The "Flat ₹150 Off for Every 7th Trip" offer is valid for customers using Jetaxi services. To qualify, customers must complete six paid trips with Jetaxi, after which every seventh trip will be eligible for a flat discount of ₹150. This discount applies only to the fare amount and is not valid for additional charges such as tolls, taxes, or tips. The discount will automatically apply during the payment process for the seventh trip. This offer cannot be combined with other promotions or discounts unless specified by Jetaxi. Jetaxi reserves the right to modify, extend, or terminate the offer at any time without prior notice, and it is subject to availability and applicable laws and regulations. Verification of customer eligibility may be required, and customers are bound by these terms and conditions upon availing of the offer.

48. Grievance Policy:

Jetaxi is committed to addressing any concerns promptly and fairly. If you have a complaint about our services, please first attempt to resolve it informally with our customer support team. If the issue remains unresolved, you may submit a formal written complaint to support@jetaxi.in, and our team will conduct a thorough review. We aim to resolve all concerns in a timely manner and will keep you updated on our progress and proposed resolution.

49. Report Abuse:

If individuals encounter any instances of abuse or inappropriate behavior, we encourage them to reach out to our support team at support@jetaxi.in immediately for assistance and resolution.
